Kuching: In the face of the Court of Appeal’s decision, Democratic Action Party (DAP) Sarawak Chairman Chong Chieng Jen issued a firm call for solidarity, reaffirming support for Michael Kong.
“Michael’s political struggle and legal battle alongside this journey has not been easy, but together with Michael, we remain steadfast in his conviction and will continue to pursue the appeal to clear his name.
“In the meantime, if you believe in the principles that underpin this case and would like to offer support and encouragement to Michael in any way, it would be most sincerely appreciated,” he said in a statement.
Chong remarks following the Court of Appeal today dismissed the application filed by his special assistant, Michael Kong to stay the execution of the High Court’s decision in the defamation suit initiated by Richard Wee.
Chong added, to recap, on 26 January 2024, the High Court awarded judgment in favour of Richard Wee against Michael Kong for the sum of RM200,000, with interest at 5% per annum from the date of publication (21 July 2020) until full settlement. The Court also ordered Michael to pay costs amounting to RM50,000.
“Michael has since appealed the High Court’s decision, and is currently waiting for the Court of Appeal to fix a date to hear his appeal.
“In the meantime, he filed an application to stay the enforcement of the High Court’s judgment, pending the final outcome of the appeal,” he said.
However, Chong said, the Court of Appeal dismissed the stay application and ordered the immediate removal of the Facebook post dated 21 July 2020.
“Michael is now required to pay the judgment sum of RM200,000, the accrued interest, and total costs amounting to RM60,000 – bringing the total financial burden to approximately RM310,000.
“While it is deeply regrettable that such a hefty amount must be paid before the Court of Appeal hear and decide on the merits of the appeal, we must nevertheless respect and comply with the Court’s decision,” he said.
